NurseAdemy — Terms of Use (EN/ES)

1) Agreement Overview

These Terms of Use (the “Agreement”) govern your access to and use of NurseAdemy LLC’s websites, platforms, products, and services (“Services”). By accessing or using any NurseAdemy Service, you agree to comply with this Agreement and the Privacy Policy.

2) Definitions

  • NurseAdemy: NurseAdemy LLC, a Florida company.
  • Website: nurseademy.com, mynursespace.com, and related platforms.
  • User: any individual using the Services.
  • Content: courses, videos, downloads, Qbanks, workbooks, graphics, audio, and all related materials.
  • User Submitted Content: content you submit.

3) License & Restrictions

You receive a personal, non-transferable license to use the Content for personal study only. You may not share access, sell, distribute, upload, reproduce, or create derivative works from the Content. Violations may result in termination without refund and legal action.

4) Prohibited Conduct

  • Illegal, abusive, hateful, defamatory, or fraudulent activity.
  • Distributing malware, scraping, or disrupting the platform.
  • Harassing staff, instructors, students, or support agents.
  • Sharing private dashboards, downloads, or links externally.

5) Accounts

One account per individual. You are responsible for safeguarding your password and all activity under your account. Shared logins are prohibited.

6) Payments — Non‑Refundable

All educational and gestoría services are non‑refundable, including courses, bootcamps, live/recorded classes, English programs, NCLEX/PRCLEX prep, Qbanks, digital downloads, and licensure gestoría. Payments are processed by third‑party processors.

7) No Guarantees

  • No guarantee of passing NCLEX, PRCLEX, TOEFL, MET, or PTE.
  • No guarantee of licensure approvals or timelines.
  • No guarantee of employment or placement.

8) Third‑Party Delays

NurseAdemy is not responsible for delays caused by Boards of Nursing, universities, credential evaluators (CGFNS, J&S, NACES, etc.), background checks, exam centers, or other third parties.

9) Intellectual Property

All materials are the exclusive property of NurseAdemy LLC and protected by U.S. copyright and trademark laws. You may not copy, distribute, alter, reverse‑engineer, or publicly post our materials without written permission.

10) Termination

We may suspend or terminate access without refund for violations including chargebacks, abusive conduct, sharing access, redistributing content, misrepresentation, or fraudulent documents.

11) Disclaimer

Services are provided “as is” without warranties of any kind, including accuracy, uninterrupted availability, or error‑free operation.

12) Limitation of Liability

To the maximum extent permitted by law, NurseAdemy is not liable for indirect, special, incidental, or consequential damages, data loss, third‑party delays, lost income, or opportunity costs. The maximum aggregate liability shall not exceed the amount you paid or $10, whichever is greater.

13) Indemnification

You agree to defend, indemnify, and hold harmless NurseAdemy from claims arising out of your misuse of the Services, inaccurate or fraudulent submissions, or violation of this Agreement.

14) Governing Law

This Agreement is governed by the laws of the State of Florida, USA.

15) Arbitration & Class Action Waiver

All disputes shall be resolved by binding arbitration in Polk County, Florida, under the American Arbitration Association (AAA) Rules. You waive the right to a jury trial and to participate in any class or collective action.

Estos Términos de Uso (el “Acuerdo”) regulan el acceso y uso de los sitios web, plataformas, productos y servicios de NurseAdemy LLC (“Servicios”). Al utilizar los Servicios, usted acepta este Acuerdo y la Política de Privacidad.

2) Definiciones

  • NurseAdemy: NurseAdemy LLC, compañía registrada en Florida.
  • Sitio Web: nurseademy.com, mynursespace.com y plataformas relacionadas.
  • Usuario: persona que utiliza los Servicios.
  • Contenido: cursos, videos, descargas, Qbanks, libros de trabajo, gráficos, audio y demás materiales.
  • Contenido Enviado por el Usuario: contenido que usted envía.

3) Licencia y Restricciones

Se otorga una licencia personal y no transferible para uso educativo. No puede compartir accesos, vender, distribuir, subir, reproducir ni crear obras derivadas del Contenido. Las violaciones pueden resultar en terminación sin reembolso y acciones legales.

4) Conducta Prohibida

  • Actividad ilegal, abusiva, difamatoria, de odio o fraudulenta.
  • Distribuir malware, hacer scraping o interrumpir la plataforma.
  • Acosar al personal, instructores, estudiantes o soporte.
  • Compartir tableros, descargas o enlaces privados externamente.

5) Cuentas

Una cuenta por persona. Usted es responsable de su contraseña y de toda actividad bajo su cuenta. No se permiten accesos compartidos.

6) Pagos — No Reembolsables

Todos los servicios educativos y de gestoría son no reembolsables, incluyendo cursos, bootcamps, clases en vivo/gravadas, programas de inglés, preparación NCLEX/PRCLEX, Qbanks, descargas digitales y gestoría para licencias. Los pagos se procesan mediante terceros.

7) Sin Garantías

  • No se garantiza aprobar NCLEX, PRCLEX, TOEFL, MET ni PTE.
  • No se garantizan aprobaciones ni tiempos de procesamiento.
  • No se garantiza empleo o colocación.

8) Demoras de Terceros

NurseAdemy no es responsable por retrasos de Juntas de Enfermería, universidades, agencias evaluadoras de credenciales (CGFNS, J&S, NACES, etc.), verificaciones de antecedentes, centros de exámenes u otros terceros.

9) Propiedad Intelectual

Todo el material es propiedad exclusiva de NurseAdemy LLC y está protegido por leyes de derechos de autor y marcas. No se permite copiar, distribuir, alterar, realizar ingeniería inversa ni publicar nuestros materiales sin permiso por escrito.

10) Terminación

Podemos suspender o cancelar el acceso sin reembolso por violaciones, incluyendo contracargos, conducta abusiva, compartir accesos, redistribución de contenido, suplantación o documentos fraudulentos.

11) Descargo de Responsabilidad

Los Servicios se brindan “tal cual” sin garantías de exactitud, disponibilidad ininterrumpida u operación sin errores.

12) Limitación de Responsabilidad

En la máxima medida permitida por ley, NurseAdemy no es responsable por daños indirectos, especiales, incidentales o consecuentes, pérdida de datos, demoras de terceros, pérdida de ingresos o costos de oportunidad. La responsabilidad máxima agregada no excederá el monto pagado por usted o $10, lo que sea mayor.

13) Indemnización

Usted acuerda defender e indemnizar a NurseAdemy frente a reclamos derivados de su mal uso de los Servicios, envíos inexactos o fraudulentos o violaciones a este Acuerdo.

14) Ley Aplicable

Este Acuerdo se rige por las leyes del Estado de Florida, EE. UU.

15) Arbitraje y Renuncia Colectiva

Todas las disputas se resolverán mediante arbitraje vinculante en el Condado de Polk, Florida, conforme a las Reglas de la AAA. Usted renuncia al juicio por jurado y a participar en acciones colectivas.
